  • Product Liability – where the product design or manufacturing was defective, or the product warning was inadequate, causing injury to the product user or a bystander.  To learn more about this practice area and our work, please visit our Products Liability Blog,
  • Motor Vehicle Collisions – you were hit by another driver.  If you were a driver, passenger or pedestrian in the collision – you may possibly make a variety of possible insurance claims, depending on the facts of your case.  We specialize in negotiating and litigating the following types of claims:
    • Personal Injury Protection (“PIP”) – on the vehicle that you were riding in, covers your medical bills, lost wages and miscellaneous, related expenses.
      • In Washington State PIP coverage is not mandatory.
      • The available limits are $10,000 or $35,000.
    • Third Party Bodily Injury (“BI”) – this is the insurance on the vehicle that caused the collision.  By the very nature of the relationship with you, they are adversarial, because they are working to protect their insured’s interest and the insurance company’s bottom-line.
      • It is best to consult a lawyer before engaging in too much communication with the third party insurance adjuster.
      •  It is best to not sign any release or authorization with third-party, either.
    • Underinsured or Uninsured Motorist (“UIM” or “UM”) – coverage on your policy where the third party has insufficient policy limits to fully compensate you for your injuries.
      • Your insurance company has a duty to act in good faith and fair dealing.
      • If your insurance company is failing to do an adequate investigation and adjustment of your claim, you may have an insurance bad faith claim pursuant to Washington’s Insurance Fair Conduct Act (“IFCA”).
